A firm believer of Dr Talleyrand's vision and a tireless worker, he is full of ideas and dedicated to making the company a true success.Political WatchFebruary 2009DEA pot raids go on; Obama opposesPresident vowed to end policyDrug Enforcement Administration agents this week raided four medical marijuana shops in California, contrary to President Obama's campaign promises to stop the raids.The White House said it expects those kinds of raids to end once Mr. Obama nominates someone to take charge of DEA, which is still run by Bush administration holdovers.“The president believes that federal resources should not be used to circumvent state laws, and as he continues to appoint senior leadership to fill out the ranks of the federal government, he expects them to review their policies with that in mind," White House spokesman Nick Shapiro said.Medical use of marijuana is legal under the law in California and a dozen other states, but the federal government under President Bush, bolstered by a 2005 Supreme Court ruling, argued that federal interests trumped state law.Dogged by marijuana advocates throughout the campaign, Mr. Obama repeatedly said he was opposed to using the federal government to raid medical marijuana shops, particularly because it was an infringement on states' decisions.“I'm not going to be using Justice Department resources to try to circumvent state laws on this issue," Mr. Obama told the Mail Tribune newspaper in Oregon in March, during the Democratic primary campaign.He told the newspaper the "basic concept of using medical marijuana for the same purposes and with the same controls as other drugs prescribed by doctors, I think that's entirely appropriate."Mr. Obama is still filling key law enforcement posts. Two were in Venice and one each was in Marina Del Rey and Playa Del Ray -- all in the Los Angeles area.A man who answered the phone at Marina Caregivers in Marina Del Rey said his shop was the target of a raid but declined to elaborate, saying the shop was just trying to get back to operating.Agent Pullen said the four raids seized $10,000 in cash and 224 kilograms of marijuana and marijuana-laced food, such as cookies. No one was arrested, she said, but the raid is part of an ongoing investigation seeking to trace the marijuana back to its suppliers or source.She said agents have conducted 30 or 40 similar raids in the past several years, many of which resulted in prosecutions."It's clear that the DEA is showing no respect for President Obama's campaign promises," said Dan Bernath, a spokesman for the Marijuana Policy Project in Washington, which advocates for medical marijuana and for decriminalizing the drug.California allows patients whose doctors prescribe marijuana to use the drug. No one under the age of 18 would be allowed to work in marijuana dispensaries.San Francisco CA - February 2009One might guess that tough economic times would only fuel the desire for mind-altering substances. For San Francisco’s cannabis clubs, however, nothing could be further from the truth.The deepening economic crisis has hit the dispensaries hard, forcing the nonprofit collectives to cut staff, business hours and donations to charities.Charlie Alazraie, manager of Bay Area Safe Alternatives, said business has dropped about 60 percent since summer, as the economy forces patients to buy smaller quantities. Alazraie had to let go of one full-time employee and two part-time workers at the small Western Addition collective.Also halted were donations to soup kitchens and low-cost health clinics that serve many of BASA’s patients. The previously profitable collective was hit with a penalty last quarter after paying their sales tax late for the first time.“This year we’re going to be so much in the red, I don’t want to find out. I know it’s going to be ugly,” Alazraie said. “We’re in arrears with our vendors, with architects, with everything.”The collective has always had a commitment to provide free medical marijuana for those in impossible situations — people who are critically ill and living in poverty were subsidized with money set aside from sales. In the past, the number of people who qualified hovered around 36. Today, there are 60.The recession hit right after many San Francisco pot clubs had spent tens of thousands of dollars to comply with legislation passed in 2005 requiring them to meet city permit regulations.Kevin Reed, founder of the Green Cross, which delivers medical marijuana to patients in San Francisco, said his sales are down 25 percent in the past 40 days, and dropped 45 percent in the past two weeks.To survive, the collective cut its hours and cut its 12 employees’ pay by $2 an hour.“It’s amazing to me,” Reed said. “It’s an industry I never thought could be affected.”Reed said he thought marijuana would be a recession-proof product, much like alcohol.“I always heard that if the economy went bad, people would be depressed,” he said. “The whole theory got blown out the window for me.”The cost of the pot hasn’t risen, but the $300-an-ounce price tag has become a heavy burden for people who have lost their jobs and cut back on expenses. Insurance does not cover medicinal marijuana.“The only busy day we’ve had in the past 40 days is when we offered a one-third off discount for veterans,” Reed said. “It seemed like half the veterans in the state signed up.”San Francisco CA – June 2007 On June 1st 2007, strict ordinance was to go into effect in San Francisco. This would require all dispensaries to only accept patients who have the state card. The airways of the lungs are lined with tissues that have microscopic cilia, or little fingerlike extensions that ‘wave’ upwards from the lungs, to the mouth and nose. The purpose is to push mucus filled with foreign toxins back up and out of the lungs to the mouth and nose, where they can be swallowed or sneezed out. Through this Initiative Measure, Section 11362.5 was added to the Health & Safety Code, and is also known as the Compassionate Use Act of 1996. The purposes of the Act include, in part: "(A) To ensure that seriously ill Californians have the right to obtain and use marijuana for medical purposes where the medical use is deemed appropriate and has been recommended by a physician who has determined that the person's health would benefit from the use of marijuana in the treatment of cancer, anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis, migraine, or any other illness for which marijuana provides relief; and (B) To ensure that patients and their primary caregivers who obtain and use marijuana for medical purposes upon the recommendation of a physician are not subject to criminal prosecution or sanction."Furthermore, Health & Safety Code section 11362.5(c) provides strong protection for physicians who choose to participate in the implementation of the Act. - "Notwithstanding any other provision of law, no physician in this state shall be punished, or denied any right or privilege, for having recommended marijuana to a patient for medical purposes."The Medical Board of California developed this statement since medical marijuana is an emerging treatment modality. The Medical Board wants to assure physicians who choose to recommend medical marijuana to their patients, as part of their regular practice of medicine, that they WILL NOT be subject to investigation or disciplinary action by the MBC if they arrive at the decision to make this recommendation in accordance with accepted standards of medical responsibility. The mere receipt of a complaint that the physician is recommending medical marijuana will not generate an investigation absent additional information indicating that the physician is not adhering to accepted medical standards.These accepted standards are the same as any reasonable and prudent physician would follow when recommending or approving any other medication, and include the following: 1. History and good faith examination of the patient. 2. Development of a treatment plan with objectives. 3. Provision of informed consent including discussion of side effects. 4. Periodic review of the treatment's efficacy. 5. Consultation, as necessary. 6. Proper record keeping that supports the decision to recommend the use of medical marijuana. In other words, if physicians use the same care in recommending medical marijuana to patients as they would recommending or approving any other medication, they have nothing to fear from the Medical Board.Here are some important points to consider when recommending medical marijuana: 1. Although it could trigger federal action, making a recommendation in writing to the patient will not trigger action by the Medical Board of California. 2. A patient need not have failed on all standard medications, in order for a physician to recommend or approve the use of medical marijuana. 3. The physician should determine that medical marijuana use is not masking an acute or treatable progressive condition, or that such use will lead to a worsening of the patient's condition. 4. The Act names certain medical conditions for which medical marijuana may be useful, although physicians are not limited in their recommendations to those specific conditions. In all cases, the physician should base his/her determination on the results of clinical trials, if available, medical literature and reports, or on experience of that physician or other physicians, or on credible patient reports. In all cases, the physician must determine that the risk/benefit ratio of medical marijuana is as good, or better, than other medications that could be used for that individual patient. 5. A physician who is not the primary treating physician may still recommend medical marijuana for a patient's symptoms. However, it is incumbent upon that physician to consult with the patient's primary treating physician or obtain the appropriate patient records to confirm the patient's underlying diagnosis and prior treatment history. 6. The initial examination for the condition for which medical marijuana is being recommended must be in-person. 7. Recommendations should be limited to the time necessary to appropriately monitor the patient. Periodic reviews should occur and be documented at least annually or more frequently as warranted. 8. If a physician recommends or approves the use of medical marijuana for a minor, the parents or legal guardians must be fully informed of the risks and benefits of such use and must consent to that use. Although the Compassionate Use Act allows the use of medical marijuana by a patient upon the recommendation or approval of a physician, California physicians should bear in mind that marijuana is listed in Schedule I of the federal Controlled Substances Act, which means that it has no accepted medical use under federal law. However, in Conant v. Walters (9th Cir.2002) F.3d 629 the United States Court of Appeals recognized that physicians have a constitutionally-protected right to discuss medical marijuana as a treatment option with their patients and make oral or written recommendation for medical marijuana. However, the court cautioned that physicians could exceed the scope of this constitutional protection if they conspire with, or aid and abet, their patients in obtaining medical marijuana. Continued Care RequirementsTitle 22, section 2383-B, subsection 5Medical use of marijuana; exemptions. The following provisions govern the medical use of marijuana. A. Notwithstanding any other provision of law, a person who is at least 18 years of age may lawfully possess a usable amount of marijuana for medical use if, at the time of that possession, the person has available an authenticated copy of a medical record or other written documentation from a physician, demonstrating that: (1) The person has been diagnosed by a physician as suffering from one or more of the following conditions: (a) Persistent nausea, vomiting, wasting syndrome or loss of appetite as a result of: (i) Acquired immune deficiency syndrome or the treatment thereof; or (ii) Chemotherapy or radiation therapy used to treat cancer; (b) Heightened intraocular pressure as a result of glaucoma;(c) Seizures associated with a chronic, debilitating disease, such as epilepsy; or (d) Persistent muscle spasms associated with a chronic, debilitating disease, such as multiple sclerosis; (2) A physician, in the context of a bona fide physician-patient relationship with the person:(a) Has discussed with the person the possible health risks and therapeutic or palliative benefits of the medical use of marijuana to relieve pain or alleviate symptoms of the person's condition, based on information known to the physician, including, but not limited to, clinical studies or anecdotal evidence reported in medical literature or observations or information concerning the use of marijuana by other patients with the same or similar conditions;(b) Has provided the person with the physician's professional opinion concerning the possible balance of risks and benefits of the medical use of marijuana to relieve pain or alleviate symptoms in the person's particular case; and (c) Has advised the person, on the basis of the physician's knowledge of the person's medical history and condition, that the person might benefit from the medical use of marijuana to relieve pain or alleviate symptoms of the person's condition; (3) The person has disclosed to the physician that person's medical use of marijuana; and (4) The person is under the continuing care of the physician. [IB 1999, c. 1, §10 (new).] B. A person under 18 years of age may lawfully possess a usable amount of marijuana for medical use if: (1) The person meets the requirements of paragraph A, subparagraphs (1) to (4); and (2) The person: (a) Has available a signed written authorization from that person's parent or legal guardian consenting to that person's medical use of marijuana; or (b) Is a minor who is entitled to give consent to all medical and other health care services pursuant to Title 22, section 1503. [IB 1999, c. 1, §10 (new).] C. Notwithstanding any other provision of law, a designated care giver may lawfully possess a usable amount of marijuana for medical use by an eligible patient if the designated care giver is acting within the scope of the designated care giver's duties to the eligible patient. [IB 1999, c. 1, §10 (new).] D. The fact that a person produces documentation described in paragraph A does not constitute a waiver of the physician-patient privilege in any other respect. [IB 1999, c. 1, §10 (new).] E. A physician who, in the context of a bona fide physician-patient relationship, advises a patient that the patient might benefit from the medical use of marijuana may not be deemed to have violated any provision of Title 32, section 2591-A, subsection 2 or section 3282-A, subsection 2. [IB 1999, c. 1, §10 (new).] F. Notwithstanding the provisions of paragraph A, medical use of marijuana by an eligible patient is not authorized by this section if such use occurs in a public place or in a workplace where such use is not permitted.
